Is Abortion Legal in Florida?

As of May 1, 2024, abortion care in Florida is legal only until 6 weeks (gestational age of the fetus measured as the time period starting on the first day of the pregnant person’s last menstrual period).

In April 2024, the Florida Supreme Court ruled against previously upheld protections linking the privacy provision in the state constitution with a woman’s right to an abortion, which allowed the six-week ban to become effective.

Given that most people do not know they are pregnant before six weeks, this ban is having a significant impact on our community, creating the need for more people to travel outside the state for abortion care.

Additional details about the 6-week ban:

  • The 24-hour mandatory waiting period requires a pregnant person to visit the abortion provider in person for counseling and wait 24 hours before returning to get the abortion
  • Ban on telehealth – physicians may not use telehealth to perform abortions and dispensing of medications intended for use in a medical abortion must be dispensed in person
  • Exceptions due to the life of the patient, physical health of the patient or lethal fetal anomaly require two doctors to certify in writing
  • Exceptions due to rape, incest or human trafficking require official documentation from the patient and follow-on reporting by providers
  • Under age 18, must have parental consent or judicial waiver

We recommend making an appointment to see a provider as soon as possible.

Judicial Bypass

Under 18 & need abortion care?

If your parents are out of the picture, abusive, don’t support you or if they’re afraid to sign official paperwork due to their documentation status or that of a family or household member, you can consider getting a judicial bypass from the court.

When you call for your appointment, let the clinic know you would like help with funding and obtaining a judicial waiver, and they will contact us at the Broward Women’s Emergency Fund (BWEF).

If you don’t have a trusted adult to go to court with you, ask them to connect you to one of BWEF’s volunteers to accompany you to court.
